CloudFran Scheduler Product Addendum (Appointments, Booking, Messaging)
This Addendum supplements the CloudFran Terms of Service and is incorporated by reference into the Master Services Agreement. The Unified Payments + Marketplace Addendum also applies to payment-related features.
1. Scope
This Addendum governs the use of CloudFran Scheduler, including appointment booking, scheduling, reminders, and related communications.
2. Appointment Booking
Users may schedule, modify, or cancel appointments through the platform. Availability is determined by the service provider.
3. Cancellation and No-Show Policy
Service providers may define cancellation windows and no-show fees. By booking an appointment, users agree to applicable cancellation and no-show policies.
4. Fees
CloudFran may process payments associated with bookings. A platform fee of 3.5% + $0.75 per transaction applies. Fees are non-refundable.
5. Chargebacks and Disputes
CloudFran mirrors payment processor protections, including dispute fees ($15). Users are responsible for chargebacks and associated losses.
6. Messaging and Communications
Users consent to receive SMS, email, or other communications related to appointments. Users are responsible for obtaining required consent under TCPA, CAN-SPAM, and other applicable laws.
7. Service Provider Responsibility
Service providers are solely responsible for delivering services, including timeliness, quality, and compliance with applicable laws.
8. Liability
CloudFran is not responsible for missed appointments, service outcomes, or disputes between users and service providers.
9. Data Usage
Scheduling and communication data may be used for analytics, reminders, and service improvement.
10. Fraud and Abuse
CloudFran may suspend accounts or cancel bookings in cases of suspected fraud or abuse.
11. Governing Law
This Addendum is governed by Delaware law with Georgia enforceability considerations.
12. Compliance
CloudFran aligns with SOC2 and audit readiness standards.
